GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions of sale are entered into between the Federation Chauffeur Toulousain (RNA W313032449), hereinafter referred to as FCT, registered under SIREN number 850909581 (formerly known as ASSOCIATION TOULOUSAINE DES VTC), and any individual, acting professionally or otherwise, (hereinafter the "Client") wishing to reserve a chauffeured car transport service or VTC (hereinafter the "Service") for their own account or on behalf of individuals who have duly authorized them to do so (the "Passenger(s)").

Booking a Service with FCT implies full and unconditional acceptance by the Client and Passengers of the general terms and conditions of sale of FCT (hereinafter the "Terms of Sale" or "T&C"). Any contrary condition put forward by the Client or the Passenger, in particular any contrary clause arising from their own general terms and conditions, is not binding on FCT unless expressly, in writing, and previously accepted by the latter.

FCT reserves the right to modify the T&C at any time. The Terms of Sale applicable to the booking of a Service are those in force on the date of the firm booking of the Service (hereinafter "the Reservation"), evidenced by FCT's receipt of written confirmation of the reservation.

FCT guarantees the proper organization and execution of the missions entrusted to it as a passenger transport company.

1. BOOKING

​

To book and/or pay for a Service, the Client must be of legal age or an emancipated minor, be legally capable of contracting, and comply with the General Terms and Conditions of Sale.

The Client is responsible for the reservations made, both on their own behalf and for Passengers when acting on their behalf. The Client guarantees the truthfulness and accuracy of the information provided.

REQUEST FOR RESERVATION

A request for reservation of a service can be made by telephone, email, via the website www.chauffeur-toulousain.com, and by any other means approved by FCT. When made by telephone, the reservation request must necessarily be confirmed in writing, notably by email or via the Chauffeur Toulousain website.

The reservation request must include the following minimum information:

Dates, times, and itineraries:

- Date, time, and place of initial pick-up of the Passenger(s)
- Final drop-off location and any intermediate stops to be respected if applicable
- Number of people to be transported (specify if the passenger is disabled and/or in a wheelchair)
- Approximate number, weight, and overall volume of luggage
Means of communication:
- Passenger's phone number

- Passenger's email
- Desired vehicle model or category

For any new Client, the reservation will only be confirmed after verification by FCT of their means of payment (see "Payment" section below).

ISSUANCE OF A QUOTE

Upon receipt of the reservation request, FCT will provide a quote based on the information provided by the Client or the Passenger.

Any changes to the information provided may result in a modification of the initial price of the Service (change of vehicle model, capacity, mileage, exceeding duration, etc.). Additionally, any services not included in the quote may be invoiced in addition to it.

CONFIRMATION OF RESERVATION

If the quote is accepted, the Client must confirm the reservation in writing to FCT by means approved by the latter ("Reservation Confirmation").

FCT's receipt of the Reservation Confirmation constitutes the formation of the transportation contract between FCT and the Client.

2. RATES

​

Services are offered at the rates indicated in the quote or order.

The pricing rules may vary depending on certain circumstances such as public holidays, periods of high activity, pick-up zone, and/or use of the Service, time of day, etc.

 

The rates are stated including VAT and include:

- Chauffeur service
- Fuel
- Professional liability insurance for "paying passengers"
- VAT at the rate set by current regulations.

Unless expressly stated otherwise in the quote, the rates do not include urban toll systems, highway tolls, parking meters, parking fees, entry fees to sites, public or private properties, or driver meals. These will be charged for any Service order lasting more than three (3) hours:
- Ending after 1:00 PM or
- Starting before 1:00 PM, or
- Ending after 8:45 PM, or
- Starting before 9:00 PM.

A driver's travel allowance will be charged for overnight stays outside the Toulouse region.

The price of the Service indicated in the quote issued by FCT may be revised by it to take into account, in particular, the increase in fuel prices and all expenses incurred for the needs of the Service.

Additional fees may be charged for specific Client requests such as baby seats, special refreshments. The amounts charged will be specified in the quote or reservation confirmation.

FCT reserves the right to modify the pricing schedule at any time without notice. These changes will be communicated to the Client and will apply to all Services booked after the pricing schedule has been updated.

OVERTIME OR MILEAGE EXCEEDANCE (EXCLUDING TRANSFER SERVICES)

For any Service, FCT may decide on a minimum billing specified in the quote.

At any time during a Service, the Client may decide to change the destination or interrupt it. In this case, the Client will be charged for the time and distance traveled and performed, and at least the package agreed upon during the reservation.

Any overtime beyond the scheduled return time will be invoiced in addition based on the applicable rate. Any excess mileage will also be charged.

3. SERVICE EXECUTION CONDITIONS

​

PICK-UP OF THE PASSENGER

The Passenger(s) must comply with the pick-up rules indicated by FCT and/or the Driver assigned to perform the Service. FCT's liability cannot be engaged if the Passenger(s) fail to comply with the pick-up procedure, which prevents the Service from being carried out.

Road regulations require Passengers to fasten their seat belts both in the front and rear of the vehicle. Failure to comply with this rule releases FCT and its affiliated drivers from liability in the event of an accident.

FCT maintains a strict no-smoking policy in all its vehicles. Failure to comply with this provision will result in the billing of cleaning and restoration costs in the amount of €250 including VAT.

Unless expressly and in writing authorized by FCT, alcohol consumption is not permitted in the vehicles. The Driver and/or FCT have the right to refuse to transport any Passenger believed to be under the influence of alcohol or drugs and whose behavior constitutes a threat to the driver, the vehicle, or any other passenger.

FCT may choose to subcontract, transfer, or assign all or part of the Service to a third party of its choice, without prior notice to the Client.

The photographs and images available on the Chauffeur Toulousain website, its brochures, and any presentation documentation are not contractual. FCT will not be liable if the car and/or driver do not correspond to the photographs or images.

FCT declares that the vehicles assigned to perform the Services are equipped with a geolocation system. By accepting FCT's Services, the Client consents to the use of this geolocation system.

BAGGAGE POLICY

The total weight of luggage is limited to what is compatible with the vehicle used, within the limit of the accessible space. The driver and/or F

CT reserves the right to refuse to load or transport any luggage that is too heavy or voluminous and that could be a risk for the safety of the vehicle and the other Passengers.

VEHICLE CAPACITY – NUMBER OF PASSENGERS CARRIED
The maximum number of passengers in the car (including the Driver) must not exceed the maximum number of passengers mentioned in the technical specifications of the car. The Driver and/or FCT reserves the right to refuse a passenger exceeding these limits.


PETS
Small dogs and other small domestic animals weighing no more than 6 kg, properly enclosed in a container not larger than 45cmx30cmx25cm, are accepted on board vehicles, up to a maximum of two. Subject to this reservation, no other domestic animals are accepted on board vehicles.

4. MODIFICATION AND CANCELLATION OF RESERVATIONS


Modification or cancellation requests are made according to one of the processes authorized for booking the Services.
Any modification or cancellation of the Reservation must be made to the FCT at least twenty-four (24) hours before the agreed time of the Service.
After these deadlines, FCT will invoice all or part of the Service reserved according to the following terms.

CONDITIONS VALID FOR ANY SERVICE
Any incidental external costs incurred by FCT (guides, hostesses, security guards) as part of a Service canceled less than 48 hours before the agreed start time will be fully invoiced.

CONDITION VALID FOR ANY SERVICE PERFORMED IN SEDAN, MPV AND VAN:
I
n case of late cancellation,
less than twelve hours before the agreed time of the Service, for a service with a distance of less than 200km and or provision with a driver of less than 2 hours
less than twenty-four hours for a service over a distance of more than 200km or provision with a driver for more than 2 hours
or “no show” 15 minutes after the meeting time set when booking the Service,
The Client will be invoiced for the amount of the total service.
In the event of a modification of the Reservation, the Service actually provided is invoiced (keeping the initial rate as a basis).

CONDITIONS VALID FOR ANY SERVICE PROVIDED BY COACH WITH MORE THAN 9 SEATS.
I
n the event of late cancellation (less than twenty-four hours before the agreed time of the Service) or “no show” 45 minutes after the meeting time fixed when booking the Service, the Customer will be billed for the amount of the entire Service initially planned multiplied by the following percentage:
Between 72 hours and 48 hours before the start of the Service: 10%
Between 48 hours and 24 hours before the start of the Service: 50%
Less than 24 hours or No Show: 100%
FCT reserves the right to apply different cancellation or modification conditions, particularly in the event of periods of high activity or for Services mobilizing a large number of Vehicles. These special conditions will appear in the quote or order summary received by the Customer and will prevail over these provisions.

5. DELAY

​

FCT is not responsible for delays caused in the event of force majeure and/or for reasons beyond its control (strikes, natural disasters, train/plane delays).

​

DRIVER DELAY
The driver is deemed late if he arrives after the meeting time fixed when booking the Service. In the event of a delay, FCT contacts the Customer to notify them of this delay and, if it is impossible to provide support, offers them an alternative solution. In the absence of an alternative solution, the Customer may be compensated, compensated or reimbursed on the understanding that the amount reimbursed, as well as the liability of the FCT, will be limited to the planned amount of the Service reserved or, when the latter is not determined , at a maximum of 150 Euros.

CUSTOMER DELAY
The Driver is required to wait for the Customer 15 minutes after the meeting time. After this period, the Customer not present at the pick-up point is deemed absent (“no-show”). In this case, the Customer will be billed for the full amount of the reservation.

6. COMMITMENT AND RESPONSIBILITY

​

FCT acts as a link between customers and companies for the activity of transporting people with drivers and as such declares to comply with the professional regulations in force.
It assumes the safety obligation that all professional carriers have towards the people transported as well as the responsibilities linked to the control of the passenger transport vehicle, whether they own or rent it.
FCT declares that it holds an insurance contract covering its professional civil liability for the exercise of the passenger transport activity and in particular all the financial consequences of bodily injury, material and immaterial damage for which it would have to respond in the framework of the provision of the Services in particular following a traffic accident and this from the passenger's entry into the Vehicle until his exit, with the exception of damage caused by the fault of the passenger.
FCT assigns drivers with regulatory capacity to carry out the Services, carefully selected, in line with the Client's needs and requests.

7. DETERIORATION

​

The Customer will be responsible for any damage caused by him or by the people with him in the car (except the Driver) or the Passenger(s) during the Service, inside the Car, and will be invoiced accordingly for any repairs or breakdowns necessary to restore the Car to a state of good operation and/or cleanliness and/or presentation.

8. REGULATION, PAYMENT AND SUPPORTING DOCUMENTS

SERVICE PAYMENT TERMS
FCT accepts the following payment methods: cash, bank cards (Visa, American Express, MasterCard), transfers (fees payable by the issuer).

When booking the Service, the Customer must provide the following documents:
Valid credit card numbers (including cryptogram)


A copy of their identity card, passport or any equivalent document
Before carrying out the Service, FCT checks with the Client's bank that their account is funded up to the amount of the Service. FCT may be required to charge a symbolic amount (<10 €) to verify the validity of the bank card provided as guarantee (this amount being deducted from the final invoice).

FCT may also request pre-authorization to debit the estimated amount of the Services from the Client's bank.
In the event that the card provided as guarantee is invalid or the account to be debited is not funded, the reservation made by the Customer cannot be confirmed by FCT and the Service subject to said reservation will not be executed.

​

Any payment by American Express or payment link will result in a payment fee of 3.0% (three percent) of the invoice amount.
